Title: Congress bill opting to ban all streaming of copyright content (Video Games)
Post by: Rocket50 on July 01, 2011, 04:31:31 PM
ALERT! Bill S.978 Will SHUT DOWN Gaming Videos and Streams EVERYWHERE (http://www.youtube.com/watch?v=hytigOSjJxc&feature=fe#ws)

So basically the American bill is to make any streaming of copyright content, meaning video game playthroughs, let's play, movie clips, music, etc as a felony and with a fine in the thousands of dollars. This includes footage in the form of youtube videos

Also this: http://shoryuken.com/2011/06/29/trolling-the-stream-by-ultradavid/ (http://shoryuken.com/2011/06/29/trolling-the-stream-by-ultradavid/)

Wtf america :<

Those Call of Duty commentaries need to be taken down. But everything else...

What the fuck? And how the fuck does that effect people/gaming companies when the game companies approve of it in the first place?

That's stupid.
Making such videos is a great way of person to person advertising and gets the word out about games and developments, so gaming industries can lose a lot of profit.
Without this I wouldn't have found Gmod.

HOLD ON A SECOND.

Even though this bill is utter crap,
it only applies to people who earn more than 2500$ a year over their streams.

AND streams are not fully disallowed even then, people will just have to get a license from the developers/publishers of that game.

Yea, hopefully this will only reflect people who do those stupid Call of Duty commentaries.

The problem is, that if the developers make a shit game, and they dont want anyone showing footage of it explaining why it is shit (by professional game critics), they wont allow it. So, this is still a problem

From what Rocket said, did it remind any of you guys of Duke Nukem Forever? People said it was going to be an awesome game and when the reviews came out they were horrible, so less people bought it...

This bill won't happen.

It's like banning movie reviews.

It just won't happen.

Julian,

Thanks to Demand Progress members like you, in less than 24 hours 20,000 more people have urged their lawmakers to oppose Senator Klobuchar's "ten strikes" bill.

Please help us seize this moment:  If you haven't urged your friends to sign on yet, would you consider doing so now? If you already have, would you re-post or re-tweet?

Thanks, and have a great holiday!  Here's the email we sent yesterday afternoon:

Julian,

We're psyched: Our campaign against Senator Klobuchar's bill to make streaming a felony is really taking off today, with user-generated videos multiplying on Youtube and people spreading word across the web.

Will you help us really push it viral?  You can use these links, or forward the email at bottom.

As the writers at TechDirt point out, under this bill you could go to jail for posting video of your friends singing karaoke:

The entertainment industry is freaking out about sites that embed and stream infringing content, and want law enforcement to put people in jail over it, rather than filing civil lawsuits.... We already pointed to one possibility: that people embedding YouTube videos could face five years in jail. Now, others are pointing out that it could also put kids who lip sync to popular songs, and post the resulting videos on YouTube, in jail as well.

That's right: Ten strikes and you could get jail time.  A month ago, the Hollywood industry magazine, Variety, reported, "Industry lobbyists pressed House members on Wednesday to pass legislation that would make illegal streaming of movies, TV shows and other types of content a felony...."

Only weeks later, the MPAA is getting its wish.

Will you help us alert the whole web, using these links or by forwarding the email at bottom?

First I screamed.

Then I was like "Oh... Canada, right"

Then I was like "BUT WHO WILL PROVIDE ME WITH ALL MY VIDJAGAEM VIDESOS (because the majority of that group lives in the USA, and most likely will just 'meh' (because most likely they couldn't be arsed to do anything about it/buy a license for a game they will review and/or play for a short period of time)?"

A few years back i believe in 2004 there was a bill very close to this, except it included alot more copyright bans. Hopefully it will not get through all of congress and everything else. Bad things will happen if it does get passed.

Copyright Disclaimer Under Section 107 of the Copyright Act 1976, allowance is made for "fair use" for purposes such as criticism, comment, news reporting, teaching, scholarship, and research. Fair use is a use permitted by copyright statute that might otherwise be infringing.

In other words its perfectly legal for game walkthroughs/commentary's.

Bill will never be passed.
