Denial of Service attacks (DoS) are very illegal, even if it is just attacking Joe Schmoe's website for a bit. Even though it is illegal, it's somewhat hard to prosecute, so generally the authorities will be reluctant to attempt to prosecute due to the difficultly of gaining the required evidence.
So unless it is the theft of secret documents, or bringing down a large website like eBay or what have you, where the loss of service for a few hours costs millions, it's unlikely that the person will be prosecuted, especially if the person is located in a country that isn't that friendly to the US (aka Russia/China).
On the other hand if overwhelming evidence can be provided there is a chance of getting someone arrested.
